Create CA is proud to fully support AB 2440, which has now passed the California Legislature with unanimous support and is headed to Governor Newsom’s desk. The bill represents an important step toward helping Prop 28 deliver on its promise: expanding high-quality arts education opportunities for every California student. By strengthening clarity, transparency, and accountability, AB 2440 will help ensure these historic resources are used as voters intended and reach students at every school.
Getting to this point took significant collaboration. As AB 2440 moved through the legislative process, partners raised important concerns about how the bill would affect Prop 28 implementation. Those concerns were addressed through the final amendments, turning previous opposition into support and bringing the coalition together around a shared goal: making Prop 28 work for all students.
What AB 2440 does:
- Helps ensure Prop 28 funds support high-quality arts education aligned with California’s arts education standards.
- Provides clearer rules for determining whether schools are meeting Prop 28’s funding requirements.
- Makes spending more transparent by requiring schools to share how they plan to use Prop 28 funds.
- Helps protect each school’s share of Prop 28 funding when funds are combined across multiple schools.
- Strengthens accountability at every school by requiring local educational agencies to confirm that Prop 28 is being properly implemented at each school site.
As we shared in our previous statement, Prop 28 has already created tremendous momentum for arts education, but implementation has been uneven across the state. The final amendments to AB 2440 address concerns raised during the legislative process while protecting Prop 28’s core promise and providing clearer, more consistent guidance for schools.
We are grateful to Assemblymember Al Muratsuchi for his leadership and willingness to bring partners together; to the California County Superintendents and the many education, arts, and advocacy partners who worked toward a shared solution; and to Prop 28 author Austin Beutner for working constructively to resolve concerns. Create CA is proud to have helped build consensus around a stronger path forward.
The Legislature’s unanimous passage of AB 2440 marks an important moment for arts education in California. Concerns were heard, the bill was strengthened, and partners came together around a shared goal: making Prop 28 work for all students. With stronger implementation and accountability, California can build on this historic investment to bring more arts educators, stronger programs, and meaningful opportunities to create, perform, and learn through the arts to students in every community.
Create CA is proud to stand with the full coalition in support of AB 2440. We now urge Governor Newsom to sign AB 2440 into law and look forward to continuing the work together to fulfill the promise of Prop 28 for California’s students.
